e-Moto App

EFFECTIVE 12 AUGUST 2026

Policies that apply when you use the Bonnell e-Moto app and related services.

EFFECTIVE DATE: 12 AUGUST 2026

Bonnell is committed to protecting user privacy and managing personal data responsibly. This Data Retention and Deletion Policy explains how long we retain information collected through the Bonnell e-Moto app and what happens to that information when an account is deleted.

1.Data Retention

We retain personal data only for as long as reasonably necessary to provide and operate the e-Moto app, maintain security, comply with legal and regulatory obligations, resolve disputes, prevent fraud or misuse, and protect our legitimate business interests.

Unless a longer period is required or permitted for the purposes described below, our standard retention periods are:

  • Account and profile data: Retained for as long as the user's account remains active.
  • App and vehicle-related data: Data associated with use of the e-Moto app, connected vehicles, devices, settings, or app functionality may be retained while the account is active and as reasonably necessary to provide the relevant services.
  • Inactive accounts: Accounts that have been inactive for more than 24 months may be deleted or anonymized.
  • Technical logs, diagnostics, and security records: Generally retained for up to 24 months, unless a longer period is reasonably necessary for security, fraud prevention, investigation, or legal compliance.
  • Analytics data: Generally retained for up to 24 months. Aggregated or anonymized information that can no longer reasonably be linked to an identifiable user may be retained for longer.

2.Account and Data Deletion

Users may request deletion of their account and associated personal data at any time.

Where account creation is available through the e-Moto app, users will be provided with a readily accessible method to initiate account deletion from within the app. We may also provide a web-based method for submitting an account deletion request.

When an account deletion request is completed, we will delete or anonymize personal data associated with the account, except for information that we are required or permitted to retain for legal, regulatory, security, fraud-prevention, dispute-resolution, contractual, or other legitimate purposes.

Deletion requests will generally be completed within 30 days, unless applicable law permits or requires a different period.

Deleting the e-Moto app from a device does not by itself delete the user's e-Moto account or data stored on our systems.

3.Data We May Retain After Account Deletion

Certain information may be retained after an account has been deleted where reasonably necessary, including for:

  • compliance with applicable laws, regulations, court orders, or other legal obligations;
  • security, fraud prevention, abuse prevention, and investigation of suspected unlawful activity;
  • establishing, exercising, or defending legal claims;
  • resolving disputes and enforcing applicable agreements;
  • maintaining records of transactions where retention is legally required; and
  • maintaining backup and disaster-recovery systems for a limited period.

Where data is retained for one of these purposes, access will be limited and the data will not be used for unrelated purposes.

Residual copies may remain temporarily in secure backup systems until they are overwritten or deleted in accordance with our backup retention procedures.

4.Third-Party Sign-In Services

If users sign in to e-Moto using a third-party authentication provider, such as Sign in with Apple, Google, or Facebook/Meta, we may receive information necessary to authenticate the user and manage their e-Moto account.

We retain this information only for as long as necessary for authentication, account management, security, and the other purposes described in this Policy.

Deleting an e-Moto account does not automatically delete the user's account with Apple, Google, Facebook/Meta, or another third-party provider. Users may need to manage those accounts separately through the relevant provider.

5.Service Providers and Third Parties

We may use service providers to host, process, analyze, secure, or otherwise support data used by the e-Moto app.

When an account or associated personal data is deleted, we will take reasonable steps to delete the relevant data from our systems and, where applicable, instruct service providers processing that data on our behalf to delete or anonymize it, subject to applicable legal and permitted retention requirements.

6.Legal and Regulatory Retention

We may retain certain information for longer than the standard periods stated above when required or permitted by applicable law or when reasonably necessary to comply with legal obligations, respond to lawful requests, protect users and our services, prevent fraud, or establish, exercise, or defend legal claims.

When the applicable retention purpose expires, the information will be deleted or anonymized in accordance with our data-management procedures.

7.Security and Disposal

We use reasonable technical and organizational safeguards designed to protect retained personal data against unauthorized access, loss, misuse, alteration, or disclosure.

When personal data reaches the end of its applicable retention period, we delete, anonymize, or otherwise securely dispose of it using appropriate industry-standard practices.

8.Contact and Deletion Requests

Users may submit privacy or data-deletion requests using the account deletion functionality provided within the e-Moto app or through the deletion request method identified on the ridebonnell.com website or app-store listing.

We may take reasonable steps to verify the identity of the person submitting a request before processing it.

For privacy questions or assistance with account or data deletion, users may contact Bonnell using the contact details provided in our Privacy Policy.

We require service providers processing personal data on our behalf to handle that information in accordance with applicable data-protection requirements and our contractual arrangements with them.

4.How We Share Information

We do not sell your personal data.

We may disclose or make personal data available in the following circumstances:

4.3 Legal Requirements

We may disclose information where required by applicable law, regulation, legal process, court order, or a valid request from a competent public authority.

4.4 Protection, Security, and Fraud Prevention

We may disclose information where reasonably necessary to protect the rights, property, security, or safety of BONNELL, our users, or others; enforce our agreements or policies; investigate suspected fraud or misuse; or protect the security and integrity of the App and related services.

5.Data Security

We implement reasonable technical and organizational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, misuse, or access.

These measures may include access controls, authentication mechanisms, secure communications, monitoring, and other appropriate technical and organizational safeguards.

However, no electronic transmission, storage system, or information-security measure can guarantee absolute security.

6.Data Retention

Aggregated or anonymized information that can no longer reasonably be associated with an identifiable individual may be retained for longer.

7.Account and Data Deletion

You may request deletion of your BONNELL account and associated personal data at any time.

Where account creation is available through the App, BONNELL will provide a method for initiating account deletion from within the App. We may also provide an online method for requesting account deletion outside the App.

When an account deletion request is completed, we will delete or anonymize personal data associated with the account, including applicable account, Garage, settings, and bike-association information, except for information that we are required or permitted to retain.

Certain information may be retained where reasonably necessary for:

  • compliance with legal, regulatory, accounting, or reporting requirements;

EFFECTIVE DATE: 12 AUGUST 2026

By accessing or using the BONNELL e-Moto App (“App”), you acknowledge that you have read, understood, and agree to these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

1.Use of the App

You agree to use the App lawfully, responsibly, and only for its intended purposes.

The App may allow you to connect to, configure, or change settings on a compatible BONNELL e-Moto or other compatible vehicle (“Bike”). Certain settings available through the App can directly affect how the Bike operates and responds to rider inputs.

You are responsible for understanding the effect of any setting before changing or enabling it.

You must not use the App in a manner that is unsafe, unlawful, interferes with the App's operation, compromises its security, or could cause harm to another person or property.

2.Minimum Age and Eligibility

You must be at least 18 years old to use the App independently.

If you are under 18, you may use the App only with the consent and supervision of a parent or legal guardian and where permitted by applicable law. Your parent or legal guardian must review and agree to these Terms on your behalf.

Use of the App does not authorize you to operate a Bike where you do not otherwise meet applicable age, licensing, registration, insurance, or other legal requirements.

3.Account Registration and Security

You may be required to create an account to access certain features of the App.

You are responsible for maintaining the confidentiality and security of your account and for activity conducted through your account.

You must only add, connect, register, configure, or control a Bike that you own or are authorized to use.

You are responsible for preventing unauthorized persons from accessing your account, the App, or settings for a Bike associated with your account.

4.User and Rider Responsibilities

You acknowledge that operating an e-Moto, electric motorcycle, e-bike, or other motorized vehicle involves inherent risks, including loss of control, collision, property damage, serious injury, and death.

You are responsible for the safe operation of your Bike and for determining whether you have the necessary experience, skill, and ability to operate it and use the features made available through the App.

You agree that you are responsible for:

  • operating the Bike safely and within your abilities;
  • ensuring the Bike is in safe working condition before riding;
  • wearing appropriate protective equipment, including a properly fitted helmet;
  • complying with applicable laws and regulations;
  • using settings appropriate for your skill level, Bike, terrain, and riding conditions;
  • maintaining control of the Bike at all times; and
  • stopping use of the Bike or a feature if you experience unexpected or unsafe behavior.

The availability of a setting or feature in the App does not mean that its use is safe, appropriate, or legal in every location or circumstance.

5.Bike Settings and Changes to Bike Behavior

IMPORTANT: SETTINGS CHANGED THROUGH THE APP MAY CHANGE HOW YOUR BIKE OPERATES AND RESPONDS.

Depending on the Bike, controller, firmware, and available functionality, App settings may affect characteristics including:

  • throttle response and sensitivity;
  • acceleration and power delivery;
  • torque;
  • regenerative braking;
  • motor braking;
  • throttle modulation;
  • power or speed settings;
  • Wheel Lift Assist; and
  • other performance or riding characteristics.

You acknowledge and agree that changing these settings may cause the Bike to behave differently from its previous configuration.

You are responsible for the settings you select and for understanding their effect before riding the Bike.

After changing a setting that affects Bike behavior, you should test the Bike carefully in a safe and controlled environment away from traffic, pedestrians, obstacles, and other hazards before normal operation.

Do not adjust performance-related Bike settings while riding.

6.Wheel Lift Assist

6.1 Enhanced-Risk Feature

Wheel Lift Assist is an advanced riding feature intended for riders who understand its operation and the risks associated with lifting the front wheel of a Bike.

Wheel lifts and riding with the front wheel elevated involve an increased risk of loss of control, overturning the Bike, collision, serious bodily injury, death, and property damage.

Do not enable or use Wheel Lift Assist unless you understand these risks and have the necessary experience and riding ability.

6.2 Effect on Bike Behavior

By enabling Wheel Lift Assist, you acknowledge and understand that the Bike's controller and associated software may automatically intervene in or modify Bike behavior based on the settings you select.

Depending on the Bike, controller, firmware, and configuration, Wheel Lift Assist may affect or control:

  • regenerative braking;
  • throttle;
  • throttle modulation;
  • motor output; and
  • other controller behavior,

including in response to Bike angles or other parameters selected by you.

Wheel Lift Assist does not replace rider control, skill, judgment, or responsibility. You remain responsible for controlling the Bike at all times.

6.3 Rider-Selected Settings

You are responsible for selecting Wheel Lift Assist settings appropriate for your own experience, skill level, Bike, terrain, environment, and riding conditions.

You acknowledge that different settings can materially change how and when the Bike responds and that a setting appropriate for one rider or condition may be unsafe for another.

6.4 Instructions and Safety Requirements

Before using Wheel Lift Assist, you must:

  • review all instructions, warnings, and safety information provided for the feature;
  • watch any instructional video required or provided by BONNELL;
  • understand how the feature and its settings affect Bike behavior;
  • select your own settings based on your experience, ability, Bike, and riding conditions; and
  • initially test the feature in a safe and controlled environment away from traffic, pedestrians, obstacles, and other hazards.

If you do not understand the operation or effect of Wheel Lift Assist, do not enable or use the feature.

Wheel Lift Assist should not be used in hazardous conditions, including high-traffic areas, around pedestrians or bystanders, on wet or icy surfaces, near obstacles, or in any situation where a loss of control could reasonably endanger you or another person.

6.5 Wheel Lift Assist Acknowledgment and Assumption of Risk

By enabling or using Wheel Lift Assist, you acknowledge and agree that:

  • Wheel Lift Assist is an advanced feature involving inherent and increased riding risks;
  • lifting the front wheel changes the stability, steering, braking, and handling characteristics of the Bike;
  • use of the feature may result in sudden or unexpected changes in Bike behavior;
  • electronic systems, sensors, software, controllers, or other components may malfunction or behave unexpectedly;
  • no electronic rider-assistance feature can eliminate the risks associated with wheel lifts;
  • you have reviewed and understood the available instructions and warnings;
  • you are responsible for selecting and understanding your settings;
  • you voluntarily choose whether to enable and use Wheel Lift Assist; and
  • you remain responsible for maintaining control and safely operating the Bike.

To the fullest extent permitted by applicable law, you voluntarily assume the risks associated with your use of Wheel Lift Assist, including the risk of loss of control, falls, collisions, property damage, serious bodily injury, or death.

7.Modifications and Unsupported Configurations

You are responsible for modifications made or authorized by you to your Bike, controller, firmware, software, electrical system, or other components.

Modifications outside BONNELL's recommendations or supported configurations may cause unexpected or unsafe behavior and may affect compatibility, functionality, support, or warranty coverage, subject to applicable law and applicable warranty terms.

You must not modify, circumvent, manipulate, or interfere with the App or its safety or security mechanisms.

8.Compliance With Laws

You are responsible for complying with all applicable laws and regulations relating to your use and operation of the Bike.

This may include age restrictions, licensing, registration, insurance, speed or power restrictions, equipment requirements, traffic laws, and restrictions on where or how a Bike may be operated.

The availability of a feature, setting, power level, or configuration through the App does not represent a determination by BONNELL that its use is lawful in your jurisdiction.

9.Intellectual Property

All content, branding, designs, software, interfaces, graphics, trademarks, and other intellectual property made available through the App are owned by or licensed to BONNELL and are protected by applicable intellectual property laws.

You may use the App only for its intended purposes and in accordance with these Terms.

10.Software, Connectivity, and Updates

App functionality may depend on compatible Bike hardware, controllers, firmware, mobile devices, operating systems, connectivity, and third-party services.

Features may occasionally be unavailable, interrupted, delayed, or affected by software errors, connectivity issues, hardware or sensor failures, incorrect configurations, or other technical conditions.

You are responsible for keeping the App and applicable Bike software or firmware updated to versions recommended by BONNELL.

You must not rely on the App or any software-based feature as a substitute for safe riding practices, rider judgment, proper maintenance, or inspection of your Bike.

11.Termination

We may suspend or terminate your access to the App or particular features if you violate these Terms, misuse the App, create a security or safety risk, or where suspension or termination is reasonably necessary to comply with applicable law or protect BONNELL, our users, or third parties.

You may stop using the App at any time and may request deletion of your account in accordance with the BONNELL e-Moto App Privacy Policy and available account-deletion functionality.

12.Disclaimer

To the fullest extent permitted by applicable law, the App and its features are provided “as is” and “as available” without warranties of any kind, whether express or implied.

BONNELL does not warrant that the App, Bike settings, or any rider-assistance feature will be uninterrupted, error-free, or capable of preventing accidents, loss of control, injury, death, or property damage.

No App feature, including Wheel Lift Assist, is a substitute for proper rider training, attention, judgment, Bike maintenance, or safe riding practices.

Nothing in these Terms excludes or limits any warranty, right, remedy, or liability that cannot lawfully be excluded or limited.

13.Limitation of Liability

To the fullest extent permitted by applicable law, BONNELL and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the App or its features.

You acknowledge that changing Bike settings or enabling performance-related features can alter Bike behavior and that you are responsible for selecting appropriate settings and safely operating and controlling the Bike.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

14.Changes to These Terms

We may update these Terms from time to time to reflect changes to the App, Bike functionality, safety requirements, our business practices, or applicable laws.

When we make changes, we will update the “Last Updated” date. Where required by applicable law, we will provide additional notice or obtain renewed acceptance.

Continued use of the App following an update constitutes acceptance of the updated Terms to the extent permitted by applicable law.

15.Privacy

Our collection, use, retention, and deletion of personal data in connection with the App are described in the BONNELL e-Moto App Privacy Policy.
